Insurance companies are in the business of protecting their clients, but unfortunately, they don’t always act in their clients’ best interests.

Sometimes, insurance companies may deny claims, undervalue claims, or use unfair tactics to minimize their payouts. When this happens, it can be difficult for clients to fight back and receive the compensation they deserve. This is where an attorney can help.

In this blog post, we will provide specific examples of how an attorney can help fight insurance companies. From denied claims to undervalued claims to unfair insurance company tactics, an attorney can be a powerful ally in these situations.

Denied Claims

One of the most common reasons why insurance claims are denied is because the insurance company determines that the claim does not meet the criteria for coverage. For example, a homeowner’s insurance policy may not cover damages caused by flooding.

An attorney can help fight denied claims by reviewing the policy, investigating the claim, and presenting evidence to support the client’s position. In some cases, an attorney may be able to overturn a denied claim, secure a higher payout, or negotiate a fair settlement.

Undervalued Claims

Insurance companies may also undervalue claims in an effort to minimize their payouts. For example, an insurance company may only offer to pay a portion of the cost to repair a damaged vehicle, even though the full cost is covered by the policy.

An attorney can help ensure that their client receives a fair and just payout by presenting evidence to support the full value of the claim, negotiating with the insurance company, or taking the matter to court if necessary.

Unfair Insurance Company Tactics

Insurance companies may also use unfair tactics to minimize their payouts, such as delaying payment, denying coverage for pre-existing conditions, or using deceptive practices.

An attorney can help fight these tactics by holding insurance companies accountable for their actions, negotiating a fair settlement, or taking the matter to court if necessary.

Recent Settlements Obtained By Landau Law

Here are a few recent settlements obtained by Landau Law to help demonstrate the many ways we help clients with insurance claims:

  • A settlement of over $850k was obtained for a single residence severely damaged in Hurricane Michael. The insurance company failed to timely communicate and fairly adjust the claim and had paid nothing until we were brought on board. We obtained the full policy limits.
  • A $650k confidential settlement against a residential energy provider for substantial property damage and personal injury. The claim involved a house fire that was caused by a downed powerline that was negligently maintained. While the claim was initially denied in full, through the course of litigation, we were able to get them to pay the full amount of damages to the property and injuries to the family.
  • A settlement of over $500k was obtained for a large condominium in downtown Miami which sustained substantial damage including the roof, windows, sliding doors, exterior and interior due to Hurricane Irma. The insurance company had initially admitted there was damage, but they claimed that the amount of damage was less than the deductible.
  • $550k obtained through arbitration for a substantial office complex in downtown Miami sustained that suffered extensive damage, including to the roof, windows and interior, due to Hurricane Irma. The claim was initially underpaid by the insurance company.
  • A settlement of over $300k was obtained for a 9-story condominium in Miami Beach that had suffered damage due to a substantial flood caused by toilet overflow. While the insurance company admitted there was damage, they initially claimed that the amount of damage was less than the deductible.
